Terms of Service

1. Acceptance of Terms

By accessing or using FocusHouse.fm (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

FocusHouse.fm is a 24/7 vocal-free electronic music streaming service with focus tools, including a Pomodoro timer, focus streaks, and listening analytics. The Service offers both free and premium tiers.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.
• One account per person. Shared or automated accounts are not permitted.

4. Subscriptions & Billing

• Premium subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize recurring charges until you cancel.
• You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact support@focushouse.fm within 7 days of a charge for consideration.
• Prices may change with 30 days' written notice. Existing subscribers retain their current rate until the next renewal after the notice period.

5. Acceptable Use

You agree not to:

• Record, redistribute, or rebroadcast any audio stream from the Service.
• Attempt to reverse-engineer, scrape, or circumvent access controls or rate limits.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Share premium account access with others or use automated tools to access the Service.

6. Intellectual Property

All music, branding, software, and content on the Service are owned by or licensed to FocusHouse.fm. You may not reproduce, distribute, or create derivative works without written permission.

7. Service Availability

We aim for 24/7 availability but do not guarantee uninterrupted service. We may perform maintenance, update content, or modify features at any time. Extended outages affecting premium subscribers will be addressed with proportional credit upon request.

8. Limitation of Liability

To the maximum extent permitted by law, FocusHouse.fm and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

• You may delete your account at any time from Dashboard → Settings. All data will be permanently removed.
• We may suspend or terminate accounts that violate these terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately. Any outstanding subscription charges are non-refundable except as required by law.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state where the operator resides.
